Please read these Terms of Service carefully before using ComPassport. By creating an account or using the platform, you agree to be bound by these terms. If you do not agree, do not use ComPassport.
ComPassport is a digital competency licensing platform operated by Dion Porter (ABN: 45642791533), trading as ComPassport, based in Victoria, Australia.
ComPassport provides a platform that allows construction workers to store, manage and share their competency licenses digitally via a unique QR code, and allows businesses and training organisations to manage workforce compliance and issue competency credentials.
References to "ComPassport", "we", "us" or "our" in these terms refer to this business. References to "you" refer to any person or organisation using the platform.
By registering for an account, accessing or using ComPassport in any way, you confirm that:
If you do not agree to these terms, you must not use ComPassport.
To use ComPassport you must register for an account. You agree to provide accurate, current and complete information during registration and to keep this information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at compassportsupport@gmail.com if you suspect any unauthorised access to your account.
Each worker may only hold one ComPassport account. RTO accounts are separate and are held by the training organisation itself. You must not create multiple accounts to circumvent any restriction or suspension.
We may require you to verify your identity or professional credentials at any time. Failure to provide satisfactory verification may result in suspension or termination of your account.
Worker accounts are provided free of charge. We reserve the right to introduce fees for premium worker features in the future, with reasonable notice given to existing users.
You are solely responsible for ensuring that all license information you upload or enter into your ComPassport wallet is accurate, current and genuine. ComPassport does not independently verify uploaded certificates unless specifically indicated.
Uploading, entering or presenting false, expired, altered or fraudulent competency credentials is strictly prohibited and may constitute a criminal offence under Australian law. ComPassport will cooperate fully with any investigation by WorkSafe Victoria, the VBA, VicRoads or any other regulatory authority.
Your competency credentials belong to you. You may export, share or delete your data at any time. Your ComPassport wallet is not tied to any single employer โ you carry it with you throughout your career.
When you present your QR code to a site supervisor or employer, you consent to that person viewing your competency license details. You control when and to whom you present your QR code.
Anyone โ a site supervisor, principal contractor, or another business โ can verify a worker's credentials by scanning their QR code or opening their verify link. No ComPassport account, business registration, or payment is required to verify a credential.
ComPassport is a credential display and verification tool. It does not replace your legal obligations as a person conducting a business or undertaking (PCBU) under the Work Health and Safety Act 2011 (Vic). You remain solely responsible for ensuring that workers are appropriately licensed for the tasks they perform on your sites.
ComPassport distinguishes between self-reported credentials (entered by the worker, not independently verified by us) and RTO-issued credentials (issued directly by the named RTO). You should exercise your own judgement about what level of verification is appropriate for your purposes, and conduct additional verification where required by law or your internal safety procedures.
Registered Training Organisations and other approved issuers who partner with ComPassport to issue digital credentials agree to:
ComPassport stores and displays competency credentials as a digital record. For High Risk Work Licences (HRWL) issued by WorkSafe Victoria and other government-issued licenses, ComPassport stores a digital copy of your existing credential โ it does not issue or replace government licences.
You are responsible for keeping your credentials current. ComPassport will send expiry alerts as a courtesy but cannot guarantee delivery of all notifications. The responsibility for maintaining current licences rests with the worker and, where applicable, their employer.
While ComPassport displays your credentials clearly, we cannot guarantee that all employers, principal contractors or regulators will accept a ComPassport QR verification in place of original documentation. You should always carry original certificates where required.
Worker accounts are free to use and will remain free. We do not charge workers to store, manage or share their own credentials.
RTOs pay a per-credential fee for each verified credential issued through ComPassport, as agreed with ComPassport as part of onboarding. This is not a subscription โ there is no monthly minimum, and fees are only incurred when a credential is actually issued.
[To be completed once payment processing is implemented โ cover billing frequency (per-issuance or periodic invoice), the payment processor used, refund policy, and consequences of a failed or overdue payment.]
We may change the per-credential issuance fee with 30 days' written notice. Price changes will not affect credentials already issued.
You agree not to use ComPassport to:
Breach of these acceptable use provisions may result in immediate suspension or termination of your account and may be referred to relevant authorities.
ComPassport and all associated content, design, software, trademarks and materials are owned by or licensed to Dion Porter trading as ComPassport. Nothing in these terms transfers any intellectual property rights to you.
You retain ownership of the competency credential data you upload to ComPassport. By uploading data, you grant us a limited licence to store, display and transmit that data solely for the purpose of providing the platform services to you.
To the maximum extent permitted by Australian law, ComPassport's total liability to you for any claim arising from your use of the platform is limited to the amount you paid us in the 3 months prior to the claim arising, or $100, whichever is greater.
We are not liable for any indirect, incidental, special or consequential loss including but not limited to loss of profits, loss of data, or any loss arising from reliance on credential information displayed on the platform.
Nothing in these terms excludes, restricts or modifies any consumer guarantee or right you have under the Australian Consumer Law that cannot be excluded, restricted or modified by agreement.
ComPassport is a credential management and display tool only. We do not verify the authenticity of government-issued licences such as High Risk Work Licences (HRWL), VBA licences or VicRoads licences unless expressly stated. We are not a licensing authority. Nothing on ComPassport constitutes legal, safety or compliance advice. Always refer to WorkSafe Victoria, the VBA, VicRoads and other relevant authorities for authoritative guidance on licensing requirements.
The platform is provided "as is" and "as available". We do not warrant that the platform will be uninterrupted, error-free or completely secure. We reserve the right to modify, suspend or discontinue any part of the platform at any time.
You may close your account at any time from your account settings. Upon closure, your personal data is permanently deleted immediately, including all licence records โ whether self-added or issued by an RTO โ and any uploaded documents or photos, subject to data we are required to retain by law. This action cannot be undone. If you create a new account in future, RTO-issued credentials will need to be reissued from scratch, as none of your previous data carries over.
We may suspend or terminate your account immediately and without notice if we reasonably believe you have breached these terms, engaged in fraudulent activity, or if required to do so by law. We will attempt to notify you of any termination where it is lawful and practical to do so.
Upon termination, your right to access and use ComPassport ceases immediately. Provisions of these terms that by their nature should survive termination โ including intellectual property, limitation of liability, and disclaimer provisions โ will continue to apply.
These terms are governed by the laws of Victoria, Australia. Any dispute arising from these terms or your use of ComPassport will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
We encourage you to contact us in the first instance to resolve any dispute informally before commencing formal proceedings.
We may update these Terms of Service from time to time. When we make material changes, we will notify you by email or by displaying a prominent notice on the platform at least 14 days before the changes take effect.
Your continued use of ComPassport after changes take effect constitutes your acceptance of the updated terms. If you do not agree to the updated terms, you must stop using ComPassport and may close your account.
